(1) Definitions and interpretation
In this Agreement “we” means Interactive-Media-Network and our Affiliates and "Members" and “you” means the relevant client.
In this Agreement, the following definitions shall apply: “Agreement” means this agreement. “Order” means your order for Products and Services made via the Site; “Products” means goods which may be purchased by you from the Site; "Services" means services which may be purchased by you from the Site; “Site” means the website at http://interactive-media-network.com .
(2) This Agreement
The advertising of Products and Services on the Site constitutes an “invitation to treat”; and your Order for Products and Services constitutes a contractual offer. In order to enter into this Agreement with us, you will need to take the following steps: “(i) you must add any of the Products and Services you wish to purchase to your shopping cart, and then proceed to the checkout; (ii) if you are a new client, you must first create an account with us and log in; if you are an existing client, you must enter your login details; (iii) after you have logged in, you will be able to retrieve any download we send to you after your purchase and track your Order (iv) you may then continue with your purchase and (vi) once we have checked that you have paid for your Order, we will send you the Product or start to work on the Service.”
We may update the version of this Agreement on the Site from time to time. The only language in which we offer this Agreement is English.
(3) The Products
We offer a variety of Products and Services (some of which may be from different vendors).
(4) Price and payment
Prices for Products or Services are quoted on the Site. In addition to the price of the Products and Services, you will/may have to pay a delivery charge. The prices on the Site include any value added or sales taxes (where applicable).
Payment for all Products and Services must be made in advance for any Product to be shipped. Prices for Products and Services are subject to change at any time, but changes will not affect Agreements which have already been paid for.
(5) Delivery
We will arrange for the Products to be delivered to the address for delivery indicated in your Order. We cannot guarantee delivery by a certain date. We do however guarantee that unless there are exceptional circumstances all deliveries of Products will be dispatched within 7 days of receipt of payment.
Shipping Method: Unless otherwise noted, the quoted shipping assumes that your package will be shipped via the least expensive method to any USA contiguous 48 state street address. If shipping is not to a USA contiguous 48 state street address, or you request an expedited shipping method, such as UPS Air, or USPS Priority or Express Mail, then shipping costs will differ. Please allow at least 14 business days for delivery in the contiguous 48 states of USA.
For AK and HI, Priority Mail should take 3 days, but USPS has no estimates for Parcel Post.
Books and printed matter: We typically ship books, CDs, videos, and the like by Media Mail.
International mail: Customers should allow 14 days for airmail delivery – longer if your parcel is held in customs, and please note that customs fees, if any, are your responsibility. Air Mail is the only remaining option for international shipments.
Please note: Interactive-Media-Network.com has no control over the delivery time for a package once it has been delivered to the carrier.
AND: Please note that unless insurance or registration is purchased, shipping is at the buyer's risk. We do have a tracking number. We do not assume any liability for Products shipped to the wrong address. The Product will be shipped to the address you give us which can be a third party.
(6) Risk and title
Ownership of the Products will only pass to you after we receive full payment of all sums due in respect of the Products (including delivery charges).
(7) Consumer rights
You may cancel this Agreement at any time within 3 days after the day you purchased the Products (subject to the limitations set out below). You may not cancel any Service or request a refund as we will be paying other people to complete the work for you.
If your claim is a defective Product, you must inform us in writing and return the Product (s) to us immediately, in the same condition in which you received it/them. Products should be returned by you within a 7 day period will have another Product shipped.
If you do not return the Products to us you will be responsible for the payment.
(8) Refunds
If you cancel this Agreement we will not refund, we will issue you a credit within 30 days of the day we received your notice of cancellation. Credit is only made for defective Products.
(9) Warranties
We warrant to you that any Product or Service you purchase through the Site will be of satisfactory quality.
You warrant to us that: you have full authority, power and capacity to enter into this Agreement and that all necessary actions have been taken to enable you to lawfully enter into this Agreement; you are legally capable of entering into binding contracts; you are at least 18 years old; the information provided in the Order is accurate; and you will be able to accept delivery of the Products and Services as contemplated in this Agreement.
(10) Limitations of liability
Subject to this: (i) our liability in connection with any Product or Service purchased through our site is strictly limited to the higher of the purchase price of the relevant Product or Service and the replacement cost of the relevant Product or Service; (ii) we accept no liability for any kind however arising and (iii) we will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under this Agreement caused by events outside our control.
This Agreement will be governed by and interpreted in accordance with the laws of Delray Beach, Florida, and the courts shall have exclusive jurisdiction with respect to any dispute arising under this Agreement.
